Job scope
•The Director, Commercial Contracts Management provides embedded commercial contracts-management capability to the commercial function: owning the drafting, negotiation, administration and lifecycle of the agreements the business runs on, structuring commercial terms soundly, managing tenant disputes and enforcement, and holding the template library. The role sits inside the commercial function for responsiveness, with a dotted line to the General Counsel for professional independence and consistency.
Accountabilities
•Owns the drafting of, and negotiation support for, concession, lease, licence, franchise and air-incentive agreements.
•Structures commercial terms, advising on the legal structuring of guarantee, percentage-rent, relief and termination provisions so that commercial intent is enforceable.
•Owns the template library, maintaining approved templates and playbooks so that routine transactions do not require bespoke drafting.
•Manages disputes and enforcement, leading tenant disputes, breach notices, arrears enforcement and settlement, and instructing external counsel where required.
•Advises the commercial lines on the regulatory and compliance constraints affecting commercial activity and contracting.
•Manages external counsel, instructing and controlling external legal spend for specialist or contentious work.
Qualifications, experience and skills
•Is a qualified lawyer, admitted or licensed to practise in a recognised jurisdiction and in good standing, evidenced by a current practising certificate or admission record — mandatory, with no exceptions.
•Brings a minimum of 10 years’ post-qualification experience, of which at least 5 years in commercial contracts within an in-house or corporate commercial environment rather than solely private-practice litigation.
•Has held direct accountability for drafting and negotiating substantial commercial agreements — concession, lease, licence, franchise or supply — having personally led the drafting and negotiation.
•Has practical experience of property, leasing or concession arrangements, evidenced through specific transactions.
•Has managed commercial disputes, enforcement and settlement, including the instruction of external counsel.
•Has a working knowledge of Omani or GCC commercial and property law and the local regulatory environment; where Omani experience is lacking, a credible plan to acquire it must be evidenced.
• Bachelor’s degree in marketing, business, digital or a related discipline, or a professional qualification benchmarked at postgraduate level (RQF / EQF Level 7 or equivalent) — for example CIM Level 7 (Chartered Marketer).
